Lifestyle Awnings & Blinds – Conditions of Order

Warranty

 

The products supplied carry a 5-year warranty on installations in respect of faulty workmanship or materials. Fair wear and tear not excepted. Fabric manufacturers supply their own guarantee of 5 years (or other stated period) on fabrics. (Exceptions: Vandalism, accidental damage, negligence, fair wear and tear, misuse, Force majeure etc.)

Permits

As all Councils have specific requirements, it is the SOLE responsibility of the CUSTOMER to obtain any necessary Permits. Lifestyle Awnings when required will obtain on behalf of the customer any necessary Parking Permits

Time Limit for Defects

In the event that the purchaser has a concern with a product that Lifestyle Awnings have installed and have deemed fully operational, it should be reported to Lifestyle within 5 working days After this time period, there will be no delaying full payment of your account. Provided that your account is paid in full, your warranty will be honored. Should payment not be made, our installer will be instructed to leave the product non operational until such a time as payment is made. All goods remain the property of Lifestyle Awnings & Blinds Melbourne Pty Ltd until paid in full.

Limitation of Liability

If any damage to your blinds and awnings is deemed to be the responsibility of Lifestyle Awnings, then the liability will be limited to the price of the Goods or Services and no claim can be made for consequential loss.

Consequences of default

Lifestyle Awnings & Blinds Pty Ltd requires payment of goods and services on or before the day of delivery. If the goods and services are not paid upon completion of the work carried out by Lifestyle, your warrenty will be void and you are liable for any related collection costs.

Alterations

This order cannot be altered without the consent of Lifestyle and then only upon such conditions as are laid down by Lifestyle. Any costs involved with alterations will be the purchasers.

Cancellations

No order may be cancelled unless a request to cancel is submitted to Lifestyle in writing signed by the purchaser. No order will be cancelled if the manufacture of the goods has commenced or completed, in which case the purchaser is liable for the full amount shown on the order. Any cancellation accepted by Lifestyle prior to the commencement of the manufacture of the goods ordered, will be upon condition that the purchaser shall pay 50% of the full amount shown on the order or the sum of $250 (whichever is the lesser amount), which it is agreed shall be the amount of liquidated damages due to Lifestyle on such cancellation.

Delivery and Installation

Lifestyle will endeavor to deliver or install goods within the time frame stated on your order, However, Lifestyle take no responsibility for late delivery or installation due to supplier delays and no claims against Lifestyle will be accepted. Where installations are delayed at the purchaser’s request beyond two weeks of the goods being notified as ready, payment of the goods less the installation cost will be paid to Lifestyle by the purchaser.

Product Maintenance

Whilst our products are built and installed to the highest standards of design and quality, it is highly recommended that regular checks and adjustments be made to ensure the safety and condition of all components.

Representations

This order form contains the entire understanding between Lifestyle and the purchaser with reference to the subject matter and there is no other understanding, agreement, warranty or representation whether express or implied in any way extending, defining or otherwise relating to the provisions hereof or binding on the parties concerned with respect to the products or the sale, manufacture or installation of the products, or any of the matters to which these products relate. To the maximum extent permitted by law, the liability of Lifestyle in connection with this contract (including liability for negligence) is limited to: (a) in the case of goods supplied in connection with this agreement, the replacement or repair costs of the goods (whichever is the lesser); and (b) in the case of services provided in connection with this agreement, the cost of supplying the services again. Lifestyle shall not be liable in any way whatsoever for any loss or damage including, but not limited to, direct, special, indirect or consequential loss damage, loss of profit, business revenue, goodwill or otherwise, resulting directly or indirectly from any act, omission, error, default or delay (whether negligent or not) of Lifestyle, its employees or agents, made in the course of supplying or installing the products.

Payment Terms

A 50% deposit is required on order and the Balance Due on the day of final installation; progressive payments are required on all structural jobs. Property in the product shall pass to the customer and the product shall only be sold to the customer on payment in full of the price. Until payment of the price in full, any delivery of the product to the customer is by way of loan only. The products are at the risk of the customer as soon as they have been delivered to the customer.
